Terms and Conditions

  • - Olivium refunds fees in compliance with the Korea Consumer Protection Agency’s rules for guests who cancel their reservations or leave Olivium earlier than agreed.
  • - Only mothers and husbands can stay in the rooms. All other family members are to use the visitors-only facilities at specific hours to protect the health of mothers and newborns.
  • - Guests cannot receive full reimbursements for the prenatal massages and other such additional services they booked but failed to show up for on time.

Terms and Conditions of Use - Olivium Premium Postpartum Care Center

Article 1 (Change of Terms and Conditions)
1. The terms and conditions of use (“the Terms and Conditions”) may be changed due to the circumstances of Olivium Postpartum Care Center (“Olivium” or “the Center”). All services shall be provided to users in accordance with the Terms and Conditions effective as of the date of reservation.

Article 2 (Payment of Contract Deposit, Guaranty Money, and Total Service Charge)
1. Upon signing the service use agreement (“the Agreement”), a user shall pay a contract deposit to Olivium corresponding to 10% of the total service charges.
2. Upon signing the Agreement, a user may use prenatal spa services and shall pay to Olivium guaranty money corresponding to 10% of the total service charge in connection with the rescission of the Agreement before checking in.
3. When checking into the Center, a user shall pay to Olivium the total service charges after the above contract deposit and guaranty money are deducted.

Article 3 (Use of Postpartum Care Service)
1. Olivium has a policy whereby one person shall use one maternity room.
2. Upon a change in a check-in date because of a changed expected delivery date, a user concerned shall notify Olivium in advance of such change.
3. Where the actual delivery date is very different from the expected delivery date, and the user inevitably needs to check into the Center, she shall comply with the following provisions:
1) Ifthe user, who will give birth within 14 days before or after the expected delivery date according to the user’s reservation, has difficulty checking into the Center, Olivium shall bear all hospital charges that the patient may incur during the waiting period: provided that the hospital charges shall cover three days and shall not exceed KRW 400,000 per day. The number of days that the user has stayed at the hospital shall be deducted from the service period of the Center;
2) If the user has difficulty checking into the Center because her childbirth is more than 14 days before or after the expected delivery date according to the user’s reservation, no hospital charges shall be borne by Olivium. In this case, the user may preferentially fill a vacancy, if any; and
3) If the user has not used all prenatal massage services, the number of services unused shall be replaced with upgraded postnatal massage program (high frequency or stone service): provided that the total number of postnatal massage services shall not be changed.

Article 4 (Service Period)
1. The basic service period shall be two weeks (13 nights and 14 days). However, a user may also reserve three weeks (20 nights and 21 days) or four weeks (27 nights and 28 days) of service period: provided that Olivium shall decide whether or not to accept five or six weeks, as the case may be.
2. A user shall check into the Center after 12:00 p.m. on the check-in date and leave the Center before 10:00 a.m. on the check-out date.
3. Where a user desires to extend the service period, she shall consult with the Center regarding the extension at least one week before and pay additional charges in full. In this case, Olivium may, if it has difficulty assigning a maternity room for its own reason, reject such request for an extension.

Article 5 (Assignment of a Maternity Room)
1. On a check-in date, a room shall be assigned to a user through consultation between the user and Olivium. In this case, the circumstances of other users and the Center shall be taken into account.

Article 6 (Restriction of Eligibility for Service)
1. In a case falling under any of the following subparagraphs, admission may be restricted: .
1) A baby whose birth weight is under 2.5 kg;
2) A premature baby with a gestational age of younger than 37 weeks;
3) A newborn baby suffering from an infectious disease;
4) A user suffering from an infectious disease;
5) A user’s husband suffering from an infectious disease; or
6) Anyone that the Center deems ineligibleto use its services, such as a person suffering from lifestyle diseases (caused by alcoholism, smoking, etc.)
2. In cases of 1), 2), and 3) above, where a user cancels her reservation, Olivium shall fully refund a contract deposit because a baby’s condition is unpredictable at the time of the reservation. Where a user, who is informed of the above restrictions, desires to check into the Center, she shall agree to write a separate pledge. Where a user only checks into the Center, without a baby, Olivium shall refund a fee for the baby (KRW 25,000 per day). In case of 4), 5), and 6), Olivium shall invalidate the Agreement concerned by fully refunding a contract deposit.

Article 7 (Rescission of Agreement before Check-in)
1. Where the Agreement is rescinded before a user’s check-in date, a contract deposit under Article 2(1) shall be refunded as follows:
1) If any injury or wrongful act is attributed to Olivium, Olivium shall refund the total contract deposit and pay damages corresponding to 100% of the contract deposit (excluding the guaranty money);
2) If any injury or wrongful act is attributed to a user, and such injury or wrongful act occurs:
- After nine days before the scheduled check-in date, no contract deposit shall be refunded;
- Within 10–20 days before the scheduled check-in date, 30% of the contract deposit shall be refunded;
- Within 21–31 days before the scheduled check-in date, 60% of the contract deposit shall be refunded;
- Within 31 days before the scheduled check-in date, or within 24 hr after signing the Agreement, the total contract deposit shall be refunded.
2. Where a user provided with prenatal spa services rescinds the Agreement before her check-in date, Olivium shall refund the guaranty money for said services under Article 2(2) by deducting charges for spa services actually given to the user.

Article 8 (Rescission of Agreement after Check-in)
1. Where the Agreement is rescinded after a user’s check-in date, Olivium shall handle each case as follows:
1) If any injury or wrongful act is attributed to Olivium, Olivium shall refund the amount that it has obtained by deducting the charges for services actually given to the user during the service period concerned from the total service charges and pay damages corresponding to 10% of the total contract deposit (excluding additional charges upon the extension).
2) If any injury or wrongful act is attributed to a user, Olivium shall refund the amount that it has obtained by deducting from the total service charges the charges for services actually given to the user during the service period concerned, plus 10% of the total service charges.
2. Where a user rescinds the Agreement after using spa services (before/after-childbirth spa services, shampooing service, etc.), Olivium shall refund the amount that it has obtained by making the following deductions from the money to be refunded pursuant to Article 8(1) above:
1) If a user leaves the Center after staying for less than seven days, the total service charges for spa services (before/after-childbirth spa service, shampooing service, etc.) shall be deducted;
2) If a user leaves the Center after staying for one (included) to two weeks (not included): service charges for spa services shall be deducted, excluding charges for i) one prenatal spa service, one postnatal spa service, and one shampooing service for a deluxe room user; and ii) two prenatal spa services, one postnatal spa service, and one shampooing service for a sweet room user;
3) If a user leaves the Center after staying for two (included) to three weeks (not included): service charges for spa services shall be deducted, excluding charges for i) two prenatal spa services, two postnatal spa services, and one shampooing services for deluxe room user; and ii) three prenatal spa services, three postnatal spa services, and two shampooing services for a sweet room user;
4) If a user leaves the Center after staying for three (included) to four weeks (not included): service charges for spa services shall be deducted, excluding charges for i) two prenatal spa services, three postnatal spa services, and two shampooing services for a deluxe room user, and ii) three prenatal spa services, four postnatal spa services, and three shampooing services for a sweet room user;
5) If a user leaves the Center after staying for four (included) to five weeks (not included): service charges for spa services shall be deducted, excluding charges for i) two prenatal spa services, four postnatal spa services, and three shampooing services for a deluxe room user, and ii) three prenatal spa services, five postnatal spa services, and four shampooing services for a sweet room user.
3. Lactation center
1) During a user’s stay at the Center
- If Olivium causes any injury or commits any wrongful act to A user, it shall refund the total payment it has received;
- If a user causes any injury or commits any wrongful act to Olivium, Olivium shall refund the amount it has obtained, deducting a penalty for breach of contract (10%of the total contract deposit),and charge the user for the services that the user has received;
- Any tickets that a user bought while staying at the Center shall not be used after checking out from the Center.
2) After a user leaves the Center
- If Olivium causes any injury or commits any wrongful act, it shall refund the total payment it has received;
- If a user causes any injury or commits any wrongful act, Olivium shall refund the amount it has obtained, deducting a penalty for breach of contract (10%of the total contract deposit) and charge the user for the services that the user has received;
- The availability period of tickets is three months.

Article 9 (Service Charge)
1. A service charge shall be paid on a one-mother and one-baby basis.
2. Upon check-in, a user shall pay service charges in full: provided that the user and Olivium may, if necessary,based on a user’s circumstance, adjust the time for payment of the balance through separate consultation.
3. When checking into the Center without a baby, a user shall pay the charged amount,which should not include the charge for the baby (KRW 25,000 per day).
4. In case of twins, a user shall pay the charged amount for two babies (KRW 600,000 per week).

Article 10 (Visiting Hour and Restriction on Entry)
1. A person who wants to see a user shall submit a letter of application for a visit by 6:00 p.m. of the day immediately preceding his/her visit.
2. Visitors may see a user from 1:00 to 5:00 p.m.
3. The number of visits per user shall be limited to two, and not more than three persons per visit shall meet a user.
4. Anyone, other than a user’s husband, shall be permitted to see the user at the designated place for up to 20 min.
5. Visitingis prohibited during rooming-in hours (9:00–10:00 a.m. / 7:00–9:00 p.m.).
6. Visitingis prohibited when flu, pneumonia, food poisoning, and eye diseases are prevalent.
7. Children under the age of 6 shall not have access to the Center.
8. Olivium may, if necessary, restrict visitors’ access to the Center to protect its users and newborn babies.

Article 11 (Leaving the Center)
1. In a case falling under any of the following subparagraphs, Olivium may request a user to leave the Center:
1) Where a user causes other users inconveniences;
2) Where a user endangers the Center by doing collective actions with other users;
3) Where a user fails to comply with her obligations to Olivium or does any act that leaves Olivium with no choice but to ask the user to move out of the Center, as prescribed by its regulations on leaving the Center; and
4) Where a user is a black consumer.

Article 12 (Duties and Disease Management of Olivium)
1. Upon the outbreaks of diseases, Olivium may instruct a user concerned to leave the Center with her baby to prevent them from being infected: in this case, the service charges shall be settled in accordance with the refund regulation.
2. Olivium shall be obligated to regularly perform health checks of its users and babies and notify a user concerned or her guardian of the results thereof: provided that it shall not be allowed to conduct medical treatment because it is not a medical institution. Thus, if a user or a baby suffers from any diseases, Olivium may, under the decision of the user or her guardian, request a medical institution to treat the user or the baby concerned or transfer to a medical institution. Should any problem arise after such request or transfer, Olivium shall not be held liable therefor: provided that if Olivium is explicitly proven to have committed any mistakes or negligence, it shall make relevant compensations in accordance with the commercial liability regulation of its insurer.
3. Without the consent of a user under the Agreement, Olivium shall not leak any of the user’s personal information to a third party.

Article 13 (Duties of a User and a Guardian)
1. When entering the Center, a user shall notify Olivium of her health status and her baby, that is, whether they are afflicted with contagious diseases (flu, pneumonia, infectious enterocolitis, and B viral hepatitis, etc.), birth (genetic) defects, unusual constitution, and other diseases. Should any problem occur due to a failure by the user or her guardian to make such notification, the user and her guardian shall be fully liable therefor and shall not raise any objection to the measures that Olivium would take.
2. To prevent a newborn from contracting diseases, a user shall strictly comply with basic principles of infection control (thorough hand-washing of a user and any persons entering the room, as well as regulations for visiting and entering the room by guardians), and if any health problem is expected or found in the user or her baby, the user shall notify Olivium of it immediately.
3. If a user or her baby has any disorder, the user or her guardian shall decide whether or not to take a medical examination.
4. If, during a user’s stay at the Center, the user has been explicitly injured because of her own (physical or mental) negligence, not because of Olivium’s facilities or other actions attributed to it, the user shall take responsibility therefor.
5. A user shall not do anything that would harm other users such as starting a fire, polluting the surroundings, drinking, etc.
6. Where a user or her visitor inflicts damage on Olivium’s property by willful misconduct or gross negligence, the user shall indemnify Olivium for such damage.
7. A user shall neither transfer her reservation to others nor, while staying at the Center, harm other users through commercial acts.
8. A user shall strictly comply with the visiting regulation, regulation for restriction on entry, and Olivium’s community life controls.

Article 14 (Compensation for Damage)
1. Where a user or her baby contracts any infectious disease at the Center, Olivium shall compensate the user for any damages based on objective materials issued by a medical institution such as a diagnosis, a medical certificate, or a receipt for hospital bills.
2. However, if Olivium proves that it is not guilty of any willful misconduct or negligence, it shall not take any responsibility for compensation.

Article 15 (Safekeeping of Valuables, etc.)
1. A user shall, if necessary, deposit her valuables and other articles in her possession at the Center. In this case, Olivium shall prepare and deliver to the user the specifications of stored goods, which shall state the product name and equivalent value thereof.
2. If a user fails to deposit her valuables, etc., at the Center, Olivium shall not be held liable for the loss or damage of such valuables, etc., unless its willful misconduct or negligence is proved.

Article 16 (Indemnification)
1. If any problem that occurred to a user and her baby is attributed to the user’s failure to comply with Article 13 (Duties of a User and a Guardian) hereof, Olivium shall not be held liable therefor.
2. Should a user sustain damages because of natural disasters, force majeure, etc., Olivium shall not be held liable therefor.

Article 17 (Jurisdiction)
1. Any lawsuit about disputes that may arise between Olivium and its user in connection with the Terms and Conditions shall be subject to the competent court prescribed by the Civil Procedure Act.

Article 18 (Miscellaneous)
1. Matters provided herein or difference in interpretation of the Terms and Conditions shall be determined by the agreement between Olivium and a user, and if Olivium and the user fail to reach an agreement, the matters shall be addressed based on the relevant laws and businesspractices.

Article 19 (Addendum)
1. The Terms and Conditions shall come into force in April 2016.

Matters to Be Observed

Hours for Visiting the Newborn and Restriction on Entry

  • 1. A person who wants to see a user and her baby shall submit a letter of application for a visit by 6:00 p.m. of the day immediately preceding his/her visit.

  • 8. Olivium may, if necessary, restrict visitors’ access to the Center to protect its users and newborn babies. Visitingis prohibited during the neonatal unit’s hours for flu disinfection (no visitors are allowed) from 9:00 to 10:00 a.m. and from 7:00 to 9:00 p.m.

Safekeeping of the Valuables, etc.

  • 1. A user shall, if necessary, deposit her valuables and other articles in her possession at the Center. In this case, Olivium shall prepare and deliver to the user the specifications of stored goods, which shall state the product name and equivalent value thereof.
  • 2. If a user fails to deposit her valuables, etc., at the Center, Olivium shall not be held liable for the loss or damage of such valuables, etc., unless its willful misconduct or negligence is proved.

Guidance on Visit

  • - A father, the husband of a user, shall only have access to a room in the Center.
  • - Lineal family members can see a baby at the neonatal unit for a while (a family visit is limited to once per week).
  • - Visitors may be allowed to see a user in the lobby from 1:00 p.m. to 5:00 p.m.
  • - When going out of the Center, a user is requested to leave the key at the front desk.
  • - When going out or staying in the lobby on the first floor, a user is requested to change into outdoor clothes.

Rescission of Agreement

  • 1. Where the Agreement is rescinded before a user’s check-in date, a contract deposit shall be refunded as follows:
  • 1) If any injury or wrongful act is attributed to Olivium, Olivium shall refund the total contract deposit;
  • 2) If any injury or wrongful act is attributed to a user, and such injury or wrongful act occurs:
  • - After nine days before the scheduled check-in date, no contract deposit shall be refunded;
  • - Within 10–20 days before the scheduled check-in date, 30% of the contract deposit shall be refunded;
  • - Within 21–31 days before the scheduled check-in date, 60% of the contract deposit shall be refunded;
  • - Within 31 days before the scheduled check-in date, or within 24 hr after signing the Agreement, the total contract deposit shall be refunded.
  • Provided that, if the contract deposit exceeds 10% of the total service charges, Olivium shall i) fully refund the amount exceeded and ii) refund the remaining amount in accordance with the ratio prescribed by the compensation criteria.
  • 3) If a user is provided with optional services, such as prenatal massage, etc., Olivium shall refund the contract deposit by deducting charges for services actually given to the user.

Rescission after Check-in

  • 1. Where the Agreement is rescinded after a user’s check-in date, Olivium shall refund the following amount in accordance with the compensation regulation for consumers’ damages of the Korea Consumer Agency (“KCA”):
  • 1) If any injury or wrongful act is attributed to Olivium, Olivium shall refund the amount it has obtained by deducting the charges for services actually given to the user during the service period concerned from the total service charges and pay damages corresponding to 10% of the total service charges.
  • 2) If any injury or wrongful act is attributed to a user, Olivium shall refund the amount it has obtained by deducting from the total service charges the charges for services actually given to the user during the service period concerned, plus10% of the total service charges.

Infection Management

  • ●  Giving top priority to the health of a user and her baby, Olivium conducts a viral infectious disease test for all entering newborn babies to ensure thorough infection control. As a result of such test, some babies may not be admitted to the Center.
  • ●  In the case of viral infectious diseases with a latent period, if a user or her baby shows any symptoms of infection while staying at the Center, Olivium may instruct the user and baby concerned to leave the Center.
  • ●  If a parent or a newborn baby is, or is likely to be, infected with a viral infectious disease before the check-in date, the admissionof such parent or baby may be canceled.
